Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Curioak LLC (“Curioak,” “we,” “us” or “our”) governing your use of the application Gifted: CogAT & NNAT Prep (the “App”) and this website (the “Site”). If you are using the App on behalf of a minor, you accept these Terms on their behalf.

1. Acceptance of these terms

By downloading, accessing or using the App or Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the App or Site.

2. License to use the App

Subject to these Terms, Curioak grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, for your and your family's personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer or attempt to extract the source code of the App, except where such restriction is prohibited by law.

3. Eligibility & parental consent

The App is intended to be purchased and managed by adults. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian. A parent or guardian who allows a minor to use the App accepts these Terms on their behalf and is responsible for supervising that use.

4. Purchases & subscriptions

The App is free to download and may offer optional in-app purchases and auto-renewing subscriptions that unlock additional content.

• Billing through Apple. All purchases are processed by Apple through the App Store. Payment is charged to your Apple Account at confirmation of purchase.
• Auto-renewal. Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• Managing & cancelling. You can manage or turn off auto-renewal in your Apple Account settings (Settings → your name → Subscriptions). Deleting the App does not cancel a subscription.
• Refunds. Purchases are handled by Apple, and refund requests are subject to Apple's policies at reportaproblem.apple.com. Except where required by law, purchases are otherwise non-refundable.
• Price changes. If we change a subscription price, Apple will notify you and, where required, ask for your consent before the change takes effect.

5. Acceptable use

You agree to use the App and Site only for lawful purposes and not to interfere with their operation, security or other users' enjoyment. You may not attempt to gain unauthorized access to any part of the App, Site or related systems.

6. Intellectual property

The App and Site, including the question-generation engine, all generated questions, artwork, text, software, the Curioak name and our logos, are owned by Curioak and protected by intellectual-property laws. These Terms grant you a license to use the App; they do not transfer any ownership rights to you.

7. Educational disclaimer

The App is a skill-building practice tool for visual, quantitative and verbal reasoning. It is not an assessment: it does not measure IQ, produce percentile or standardized scores, diagnose or evaluate any condition or ability, or determine test readiness.

The App is not affiliated with, endorsed by or sponsored by any school, school district, testing organization or assessment publisher, and it does not guarantee or predict any particular score, screening result, placement or admission outcome. All practice questions are original and generated by the App; no real test items are used or reproduced.

8. Third-party trademarks

CogAT® is a registered trademark of Riverside Insights. NNAT® is a registered trademark of Pearson Education, Inc. These marks are used in the App name and on the Site only to describe the style of reasoning practice the App provides, a nominative and descriptive use. Curioak claims no rights in them, and their owners have no affiliation with, and provide no endorsement or sponsorship of, the App. All other third-party names and marks are the property of their respective owners.

9. Disclaimer of warranties

The App and Site are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, Curioak will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising out of or relating to your use of the App or Site. Our total liability for any claim relating to the App will not exceed the amount you paid us (through Apple) for the App in the 12 months before the claim.

11. Apple App Store terms

These Terms are between you and Curioak LLC only, not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with the Apple Media Services Terms and the standard Licensed Application End User License Agreement (EULA). If any Curioak term conflicts with Apple's EULA, the terms more protective of you as the end user will apply to the extent required.

12. Changes & termination

We may update these Terms from time to time; when we do, we'll revise the “Last updated” date above. Continued use after changes means you accept the updated Terms. We may also modify, suspend or discontinue the App or any feature at any time. You may stop using the App and delete it at any time.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You and Curioak agree to the exclusive jurisdiction of the state and federal courts located in the State of California for any dispute not subject to arbitration or small-claims court, except where prohibited by applicable law. Nothing in this section limits any consumer-protection rights you may have under the laws of your place of residence.
